Its purpose is to analyze how these appointments were made, as well as to identify potential risks related to politicization of the process. The analysis is based on data sourced from answers provided on the basis of Law 544/2001 by the National Health Insurance House (CNAS) and the Ministry of Health (MS). Information from the portal developed by EFOR www.banipartide.ro, declarations of assets and interests published on the ANI portal integritate.eu and from media sources were also used.

In this report we will focus our attention on the appointments in the positions subordinated to that of director general, more specifically, in the positions of:

CAS Executive Director of Economic Department

CAS Executive Director of Contractual Relations Department

CAS Deputy Executive Director/Chief Medical Officer

DSP Deputy Executive Director for Economic Affairs

DSP Deputy Executive Public Health Director

Read the full report here

General conclusions

For CAS:

As it is the case for CAS Directors-General, the office terms of Executive Directors are unstable, due to the high number of temporary appointments. The analyzed data show that about 63% of the Executive Directors (all departments included in the analysis) are appointed on a temporary basis, while only 37% are appointed through competition. This way of administering the institutions can affect the quality of management and the predictability of filling in a public position.

Office terms vary from county to county. Some terms were very short. For example, a CAS Executive Director of Economic Department in Satu Mare had a term of office of only 4 days, an Economic Director at Bucharest Municipal CAS had a term of office of only 9 days and another a term of office of 11 days. However, it is difficult to compile a statistic that shows precisely the average length of terms of office, as in some cases the exact starting date of the term of office is unknown.

In most of the counties, between 2-4 appointments were made by temporary exercise. In 14 counties there were more than 2 temporary appointments for the position of economic director, in 15 counties there were more than two appointments for the position of director of contractual relations that were not made using a public competition and in 10 counties more than 2 Chief Medical Officers were appointed by such means. There are counties such as Dâmbovița, Vrancea, Botoșani Ilfov or Satu Mare – where we observe several rotations on the same post. Most appointments were made for Bucharest positions.

In general, there is little competition in the public competitions that are organized, and in some cases all candidates failed or failed to show up. It should be noted that only four public competitions were held in 2018-2022, their organization was limited by various normative acts.

In 2021, public competitions were organized for 45 positions of Executive Director of Economic Department, Executive Director of Contractual Relations Department and Deputy Executive Director/Chief Medical Officer in several counties across the country. In 2022, 3 competitions were held for Bucharest Municipal CAS for these three positions, where only one candidate applied.

We identified possible links with the political environment (party members, donors, candidates, etc.) in almost 7% of cases.

The data provided show that in general there is room for improvement in the record-keeping of appointments. For example, it was difficult to obtain an archive of appointments for the last ten years, as the data was specifically collected by CNAS from the county health insurance offices in order to receive a response. Some calculations were not possible as we did not receive sufficiently detailed data.

For the DSP

Only in 7 counties were a Deputy Executive Economy Director and a Deputy Executive Public Health Director appointed within the same institution. In 3 counties – Covasna, Olt and Bucharest – both posts were vacant.

Out of the total, 72% of the posts were filled by public competition, 20% by temporary exercise and the rest were vacant.

8 of the 47 directors have possible links with various political parties (members, donors, contributors).

Project funded by the US Department of State, Bureau for Democracy, Human Rights and Labor (DRL), and coordinated by CEELI Institute.

The report analyzes how appointments was conducted at the public health directorates (DSP) and county health insurance departments (CASJ) for executive/deputy directors and is a follow-up to an analysis published in 2022.
